1. Copyright Infringement Policy

TheMarketBug LLC ("we," "us," or "our") respects the intellectual property rights of others and expects users of CreatorFramework ("the Service") to do the same. We will respond to clear notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512.

This policy describes how to report copyright infringement on the Service, how we respond to such reports, and the process for filing a counter-notification if you believe your content was removed in error.

2. What Constitutes Infringement on This Service

CreatorFramework allows users to upload video files for analysis and to share creator datasets on the marketplace. Infringement on this Service may include:

  • Uploading video content you do not own or do not have authorization to analyze
  • Sharing creator datasets on the marketplace that contain copyrighted material without authorization
  • Using generated scripts or analysis data to produce content that infringes on the original creator's copyrights

Note: Analyzing publicly available content for educational, research, or commentary purposes may constitute fair use. We evaluate each takedown notice on its merits before taking action.

3. Notification of Claimed Infringement (Takedown Notice)

If you believe that content on the Service infringes your copyright, you or your authorized agent may send us a takedown notice. Under 17 U.S.C. § 512(c)(3), a legally effective takedown notice must include:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed
  2. Identification of the copyrighted work claimed to have been infringed, or a representative list of such works if multiple works are covered
  3. Identification of the material that is claimed to be infringing and that is to be removed or have access disabled, including information reasonably sufficient to permit us to locate the material
  4. Your contact information, including address, telephone number, and email address
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  6. A statement, under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the owner of the exclusive right that is allegedly infringed

4. Counter-Notification

If you believe that your content was removed or disabled as a result of a mistake or misidentification, you may file a counter-notification with us. Under 17 U.S.C. § 512(g), a counter-notification must include:

  1. Your physical or electronic signature
  2. Identification of the material that was removed or disabled and the location at which the material appeared before it was removed or disabled
  3. A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  4. Your name, address, telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the federal district courts in which TheMarketBug LLC may be found if your address is outside the United States), and that you will accept service of process from the person who provided the original takedown notice or an agent of such person

Upon receipt of a valid counter-notification, we will forward a copy to the original complaining party. The removed material will be restored within 10-14 business days unless the copyright owner files a court action against you.

5. Repeat Infringer Policy

In accordance with 17 U.S.C. § 512(i), we will terminate the accounts of users who are repeat infringers. A user is considered a repeat infringer when three or more valid takedown notices have been filed against their account and we have determined, after review, that the notices are valid. Each determination is made on a case-by-case basis, considering the nature of the infringement, the user's response, and the availability of fair use defenses.

6. Our Response Process

When we receive a valid takedown notice, we will:

  • Acknowledge receipt of the notice within 2 business days
  • Review the notice for completeness and legal sufficiency
  • Remove or disable access to the allegedly infringing material expeditiously
  • Notify the affected user that the material has been removed and provide instructions for filing a counter-notification
  • Maintain records of all notices for legal compliance

8. False Statements

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be liable for damages, including costs and attorney fees. Similarly, any person who knowingly materially misrepresents that material was removed or disabled by mistake or misidentification may be liable for damages. We take misrepresentations seriously and may pursue legal recourse against parties who file bad faith notices or counter-notices.
