Terms of Service

1. Acceptance of Terms

By accessing or using CreatorFramework ("the Service"), operated by TheMarketBug LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

CreatorFramework provides creator intelligence tools including video analysis, cross-video pattern extraction, script generation, script retrofitting, creator comparison, and a marketplace for sharing creator datasets. The Service processes video files uploaded by users and generates analysis reports, pattern data, and generated scripts.

3. User Accounts

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 18 years old to create an account. You agree to provide accurate and complete information when creating your account and to update it as necessary.

4. Usage Limits

The Service offers tiered usage plans with monthly video analysis quotas. Free accounts are limited to 2 video analyses per month. Paid plans offer higher quotas as described on our pricing page. Unused quota does not roll over to subsequent months. We reserve the right to adjust quotas and pricing with 30 days notice.

5. User Content & Data Retention

You retain ownership of all video files and content you upload to the Service. By uploading content, you grant TheMarketBug LLC a limited, non-exclusive license to process and analyze the content solely for the purpose of providing the Service. We do not use your content for any other purpose.

You represent and warrant that you have the right to upload and analyze any content you submit to the Service.

Data Retention Policy. Video files and transcripts are automatically deleted from our servers after analysis completes. Only derivative analysis data — structured analysis reports, pattern data, and thumbnails — is retained. Video thumbnails are retained for identification purposes under fair use. This means:

  • Video files are retained only during active processing and are permanently deleted upon analysis completion
  • Transcripts (word-for-word text) are deleted after analysis completes
  • Structured analysis, patterns, and thumbnails are retained until you delete your account or the associated data
  • Once source data is deleted, re-analysis is no longer possible for that video

You may delete your analysis data at any time through the Service. Upon account deletion, all associated data is permanently removed.

6. Generated Content

The Service generates analysis reports, pattern data, and scripts based on your uploaded content. You own the generated content produced from your uploads. TheMarketBug LLC does not claim ownership of generated scripts, analyses, or pattern data.

Generated content is produced by automated systems and is provided for informational and creative purposes. You are solely responsible for reviewing, editing, and using any generated content. TheMarketBug LLC makes no guarantees regarding the accuracy, originality, or suitability of generated content for any particular purpose.

7. Marketplace

The Service may include a marketplace where users can share, browse, and clone creator datasets. By sharing content on the marketplace, you grant other users a limited license to use that shared data within the Service. You retain ownership of any original content you share.

Marketplace ratings, reviews, and comments are the responsibility of the users who post them. TheMarketBug LLC reserves the right to remove marketplace content that violates these terms or is reported as inappropriate.

8. Acceptable Use

You agree not to:

  • Upload content that is illegal, harmful, threatening, abusive, or violates the rights of others
  • Upload content you do not have the right to upload and analyze
  • Attempt to reverse engineer, decompile, or extract the underlying AI models or proprietary algorithms
  • Use the Service to generate content that impersonates or defames any person
  • Resell or redistribute access to the Service without written permission
  • Interfere with or disrupt the Service or servers connected to the Service

9. Payment and Billing

Paid plans are billed monthly through our payment processor. Prices are listed on our pricing page and may be updated with 30 days notice. You may cancel your subscription at any time. Upon cancellation, you will retain access to paid features until the end of your current billing period.

Refunds. You may request a full refund of your initial subscription payment within 7 days of purchase by contacting support@themarketbug.com or through your account settings. After the 7-day window, no partial refunds are provided for unused portions of a billing period.

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance or experience outages. We will make reasonable efforts to notify users of planned downtime. TheMarketBug LLC reserves the right to modify, suspend, or discontinue any part of the Service with reasonable notice.

11. Termination

We may suspend or terminate your account at our sole discretion if you violate these Terms of Service. Upon termination, your right to use the Service will immediately cease. We will provide notice of termination via email when possible. Provisions that by their nature should survive termination shall remain in effect, including sections on liability, warranties, and intellectual property.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. AI-generated analyses and scripts are provided for informational purposes and should not be considered professional advice. TheMarketBug LLC does not guarantee the accuracy, completeness, reliability, or usefulness of any analysis report or generated content.

13. Limitation of Liability

To the maximum extent permitted by law, TheMarketBug LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the Service.

14. Indemnification

You agree to indemnify and hold harmless TheMarketBug LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

15. Intellectual Property

The Service, including its original content, features, functionality, software, and underlying technology, is owned by TheMarketBug LLC and is protected by copyright, trademark, and other intellectual property laws. Our trade name, trademarks, and service marks may not be used without our prior written permission.

16. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of material changes by posting the updated terms on our website and, when practical, via email. Your continued use of the Service after changes constitutes acceptance of the updated terms.

17. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the United States and the state in which TheMarketBug LLC is organized, without regard to conflict of law principles.

18. Dispute Resolution

Any disputes arising from these Terms of Service or your use of the Service shall be resolved through good-faith negotiation first. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to participate in class action lawsuits or class-wide arbitration.
